Mesothelioma Legal Advice
Cancer
Mesothelioma is cancer of the lining surrounding the lungs, ribs (pleura), and organs found in the abdomen (peritoneum). In the United States, the only known cause of this form of cancer is caused by exposure to asbestos.
Asbestos
Asbestos is a mineral. At one point, it was used by the construction industry to make insulation. Asbestos fibers are easily inhaled and exposure to this substance has been linked to mesothelioma, as well as other lung diseases.
Exposure to Mesothelioma
An individual who has been exposed to mesothelioma will most likely not develop symptoms immediately. In some cases, symptoms of the disease do not become apparent for a number of years; Mesothelioma has been known to lie dormant in the body for more than 25 years!
Symptoms of Mesothelioma
If you experience any of the following symptom, make an appointment immediately to see a doctor:
- Shortness of breath
- Pain in the chest, back, or abdomen
- Abdominal swelling
- Coughing up blood
Though these symptoms may be caused by a number of disorders unrelated to mesothelioma, if you were exposed to asbestos in the workplace, seek medical advice to determine your risk of developing this condition.
Starting a Lawsuit for Mesothelioma
Consult an Attorney
If you have been diagnosed with this cancer and would like to receive mesothelioma legal advice, contact an attorney who practices in the area of occupational health and safety immediately. There are time limits during which you need to start an action to recover damages.
If you have consulted with a doctor and have not been diagnosed with mesothelioma, do keep a close eye on your health. Seek medical advice if you notice changes in your condition. Make sure that all physicians who treat you are aware that you have been exposed to asbestos.
Gather Information to Support Your Claim
You will need to provide your lawyer with documentation to support your claim for damages. Be prepared to share information with your lawyer, investigator, or other personnel from the law office about your employment and medical history. You will also be asked to discuss your exposure to asbestos.
Sign a Release
The law office will also ask you to sign a release to order copies of your employment and medical records. This is standard procedure. It may feel a little uncomfortable for you to give access to personal information to your lawyer.
Keep in mind, though, that he or she needs to gather all pertinent information in order to represent you in the best possible manner. Your information is confidential and will not be discussed with personnel not actively working on your case.
Filing the Complaint
Once it has been determined that you have grounds to start a lawsuit, the complaint will be filed. Your lawyer will advise which individuals or companies you will be suing in the legal action. These may include:
- The mining company
- Contractors who used asbestos products
- A company that distributed asbestos products
- The owner of the building where you were exposed
Workers' Compensation Claim
Another option for people who have been diagnosed with mesothelioma is to make a claim for benefits under their employer's workers' compensation plan. A claim can be made in addition to or instead of starting a lawsuit.
Some people are uncomfortable about going after an employer for benefits, especially if their relationship has been a good one. Employers are required to purchase coverage to insure against workplace injuries. Making a claim under the workers' compensation system does not mean that you are claiming your employer is at fault.
Since each case is different, do consult with an attorney to get appropriate legal advice for your situation.
